Terms of Service

eMenu gives restaurants tools to publish a digital menu, create QR codes, receive orders and manage their business, and gives diners a way to browse menus and place orders. Helpro Limited provides the platform. We are not a restaurant, we do not prepare or deliver food, and each order is an arrangement between the diner and the restaurant.

• You must be at least 18 and able to enter a binding agreement to open a restaurant account. If you sign up for a business, you confirm you can act for it.
• Give accurate information and keep it up to date.
• Keep your password secret. You are responsible for activity on your account, so tell us promptly if you suspect misuse.
• You are responsible for the people you give access to your restaurant account and for what they do with it.

You are responsible for:

• the accuracy of your menu, including dish names, descriptions, prices, photos and availability;
• information about allergens and dietary claims such as vegetarian, vegan, halal or gluten-free. Only state what you can stand behind;
• holding the licences and permits your business needs, and meeting food safety, tax and consumer laws that apply to you;
• preparing and serving the orders you accept, and handling any payment, refund or complaint with your customers;
• printing and placing QR codes in a way that matches the table or branch they are created for;
• having the right to use every image and piece of text you upload.

• Menus, prices and availability are set by the restaurant. We cannot guarantee that a dish is available or that a price has not changed.
• When you place an order you are asking the restaurant to prepare it. The restaurant decides whether and how to fulfil it.
• If you have allergies or dietary needs, tell the restaurant directly before you eat. Do not rely only on what a menu shows.
• Do not place false or abusive orders.

eMenu does not currently process payments. Any payment for an order is settled between the diner and the restaurant. If we add online payments, we will update these Terms and explain how they work before they start.

Restaurants can start for free. Paid plans, where offered, are described on our site with their price and what they include. We will give notice before changing the price of a plan you are on, and a change will not apply to the period you have already paid for.

You agree not to:

• break the law or help anyone else to;
• upload content that is unlawful, misleading, defamatory, hateful, or that infringes someone else's rights;
• attempt to access accounts, data or systems that are not yours, or test the security of the service without our written permission;
• interfere with or overload the platform, or use bots or scrapers that harm it;
• copy, resell or reverse engineer the service except as the law allows;
• use eMenu to send spam or unwanted marketing.

Restaurants keep ownership of their menus, images, logos and other content. You give Helpro Limited a non-exclusive licence to host, display and distribute that content as needed to run eMenu, including showing it on your public page and in the eMenu directory.

eMenu, including its software, design and branding, belongs to Helpro Limited and its licensors. These Terms give you a right to use the service, not to own any part of it.

eMenu may link to or rely on services that we do not control. We are not responsible for those services or for the content of other websites.

We work to keep eMenu available and accurate, but we do not promise it will always be uninterrupted or error-free. We may add, change or remove features. If we make a change that significantly affects restaurants, we will tell you.

You can stop using eMenu and ask us to delete your account at any time. We may suspend or end an account that breaks these Terms, puts others or the platform at risk, or is required by law, and we will explain why where we can. Sections that by their nature should continue after the account ends, such as those on content, liability and governing law, continue to apply.

To the extent the law allows, eMenu is provided "as is" and "as available". We do not make promises about results such as sales, order volumes or search ranking, and we are not responsible for the food, service or conduct of any restaurant.

To the extent the law allows, Helpro Limited is not liable for indirect or consequential losses, lost profits or lost data arising from your use of eMenu. Our total liability for any claim related to the service is limited to the amount you paid us for the service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

These Terms are governed by the laws of the country in which Helpro Limited is registered. Disputes will be handled by the courts of that country, unless mandatory consumer law in your country gives you the right to use your local courts.

We may update these Terms. We will change the date at the top of this page and, for significant changes, tell you in the product or by email. If you keep using eMenu after a change takes effect, you accept the updated Terms.
